How Blogging Can Land You In Jail

prison.jpgHat tip to Jessica of Inman News for this article which points to an entry on AvivaDirectory about blogging lawsThe folks at Redfin just got fined $50K for breaking some arcane NWMLS rules, but the laws discussed here are Federal and State laws and have some real teeth to them.

While some of the laws mentioned should be pretty obvious — don’t blatantly plagiarize and give due credit — others are pretty surprising.  Did you know, for instance, that you need to be extra careful and explicit with your citations when you “deep link” — ie you create a link to a non-home-page of some other site?  Also, you need to be careful with using images from other sites:  you need to either explicitly get permission from the site owner, or you need to re-size the picture to standard thumbnail size, and link that thumbnail to the original site.  The article does not mention simply giving credit to the original site (e.g. image courtesy of nasa.gov) which is what many bloggers do.  In my layman’s view, that seems identical to quoting a paragraph or two from another site and honoring them with a citation.
